This matter came before the Court on the 6th day of March,
2006 for a status hearing. Present were Harriet Charley, and
Pearl Charley. Not present were Brenda Cirk, Marian Mosqueda,
Terry Charley, Margaretann Charley, Leroy Charley, Bernard
Charley, Dale Charley, Steve Charley, and Madgapie Charley.
Findings of Fact
The Court after reviewing the file, record, and applicable law
finds that there is now service on Steve Charley, Brenda Cirk,
Terry Charley, Mariann Mosqueda, Margaretann Charley, Leroy
Charley, and Bernard Charley and Dale Charley. Not served was
Madgapie Charley. The Colville Tribal Law and Order Code (“CTC”)
requires that there be personal service or certified mail
(green card with signature returned and filed in Tribal
Court).
After service has been performed on all respondents, the next
issue will be that the CTC requires two Notarized doctors
reports, that testify that Harriet Charley is or is not able
to handle her present affairs and whether it is in Harriet’s
best interests that a guardian be appointed. The Court has
accepted two notarized doctor’s letters.
The Court has heard earlier from Marian Mosqueda that she is
willing to be a stand-by guardian, willing to act as guardian
if Pearl Charley is unavailable. The Court has accepted a bank
statement of Harriet Charley’s banking account. The Code also
requires that three disinterested persons act as appraisers
and sign a notarized affidavit of any property of Harriet
Charley valued over $1,000.00.
Order
It is so ORDERED, ADJUDGED, and DECREED that:
1. The Respondent Madgapie Charley must be personally served
or served by substituted service by the next hearing.
2. The Respondents may be served via publication in two
consecutive issues of the Tribal Tribune. However, notice must
specify the date below and notice must be published in two
public places on reservation pursuant to CTC 2-2-70 and Pearl
Charley must provide written proof of this.
3. The next guardianship hearing will be June 5th, 2006 at
1:00 PM. This order shall serve as notice to all parties.

The Bureau of Reclamation operates, and has maintenance
responsibility for a facility that treats sanitary wastes
generated from employees and visitors at the Right Power House
and the Third Power House. The facility’s application
indicates that the design flow of the facility is 0.018
million gallons per day (mgd). Sanitary wastewater will be
treated through secondary treatment with chlorine contact.
Treated and disinfected effluent is discharged from the
facility via a submerged single port outfall pipe into the
Columbia River. The outfall is located about 100 feet from
shore at a depth of ranging from 40 to 70 feet below surface.

2. Tentative Determination
The Region 10 Office of the EPA has tentatively determined to
re-issue a discharge permit to the above listed applicant.
3. State Certification
Section 401 of the Clean Water Act requires EPA to certify
before issuing a final permit. Since the discharge is from a
facility located within the boundaries of the Confederated
Tribes of the Colville Reservation, the provisions of Section
401 of the Clean Water Act requiring state certification of
the permit do not apply. Therefore, EPA will certify in
accordance with Section 401.
4. Public Comments
Persons wishing to comment on the tentative determinations
contained in the proposed permit or wishing to request that a
public hearing be held, may do so in writing, within 30 days
of the date of this public notice. A request for a public
hearing shall state the nature of the issues to be raised as
well as the requester’s name, address and telephone number.
Comments must be received within this 30 day period to be
considered in the formulation of final determinations
regarding the application. All comments should include the
name, address and telephone number of the commenter and a
concise statement of the exact basis of any comment and the
relevant facts upon which it is based. All written comments
and requests should be submitted to EPA at the above address
to the attention of the Director, Water Division.
5. Administrative Record
The proposed NPDES permit and other related documents are on
file and may be inspected at the above address any time
between 8:30 a.m. and 4:00 p.m., Monday through Friday. Copies
and other information may be requested by writing to the EPA
