This matter came before the Court for hearing on the DCS Motion to Establish Respondent Renion’s child support obligation for the above-captioned child.
DCS was present. The Respondent was not present. The Mother/Respondent was not present. At the hearing, DCS made an oral Motion (“Motion”) For Order Permitting Substituted Service.
The Court has considered DCS’ Motion as well as the records and files in this matter, and, hereby enters the following:
Findings of Fact and Conclusions of Law
1. DCS has made diligent efforts to serve Respondent Renion with the DCS Motion to Establish Respondent Renion’s Support Obligation For Child and For Hearing (Motion to Establish), including attempts to serve the Motion to Establish on Respondent Renion by certified mail at his last known mailing address, by Tribal Police at his last two known physical home addresses, and at Okanogan County jail during a period of recently reported incarceration, but those attempts have been unsuccessful.
2. There is an adequate basis and good cause shown for the Court to permit substituted service of the Motion to Establish in this matter on Respondent Renion, as specified in Code 2-2-71(b).
Based on the foregoing, the Court makes the following:
Order
1. DCS shall be permitted to perform substituted service of the Motion to Establish in this matter on Respondent Renion in the manner specified in Code 2-2-71(b). Specifically, DCS shall post a conformed copy of the Motion to Establish in the Colville Tribal Headquarters Building for three (3) weeks, and DCS shall post a copy of the Motion to Establish in the Inchelium Tribal Community Center for three (3) weeks. DCS shall also have the Colville Tribal Tribune publish, for two (2) consecutive issues, the Notice Of Motion to Establish Child Support Against Skywalker Renion,, substantially in the form as set forth at the end of this Order.
2. DCS shall provide the Court with proof of having completed the substituted service as set forth in the preceding paragraph.

Notice Of Motion to Establish Child Support Against Skywalker Renion

The State of Washington, Department of Social and Health Services, Division of Child Support (DCS) has filed a Motion to Establish Respondent Renion’s Support Obligation for the child, Skywalker Ronnie Romero-Renion, who was born on January 10, 2002 (the “Child”). The case number is CV-PT-2002-22388.
DCS alleges that Colville Tribal Court, on September 11, 2003, entered an Order determining you to be the father of the Child. DCS alleges that you owe a duty of providing financial support for the Child, specifically, to pay child support each month for the support of the Child, under the laws of the Confederated Tribes of the Colville Reservation.
DCS asks the Court to set your monthly support obligation for the Child based on Tribal law and the Colville Tribal Child Support Guidelines and based on the combined monthly net income of you and the Child’s mother. DCS also asks the Court to set the amount of the back child support you owe and the amount that you should pay each month to repay that back child support amount.
You have the right to appear and be heard on all the issues raised in the Motion to Establish. You have the right, at your own expense, to be represented by a Tribal spokesperson or attorney, in this matter. You may file an Answer to the Motion to Establish Child Support.
The Court has set a hearing on the Motion to Establish for Tuesday, May 9, 2006, at 9am.
If you do not file a written Answer and do not appear in Court at the scheduled hearing and the Court finds you have been properly notified by DCS, the Court may grant what DCS asks for in the Motion to Establish Child Support.
